Welcome to Isthetique. These Terms and Conditions (“Terms”) govern your use of our medical tourism services, website, and any related services provided by Isthetique Medical Tourism Agency. By accessing our website or using our services, you agree to be bound by these Terms.

1. Definitions

For the purposes of these Terms:

  • “Company” (referred to as “we,” “us,” or “our”) refers to Isthetique Medical Tourism Agency
  • “Service” refers to our medical tourism coordination services, website, and related offerings
  • “Patient” or “Client” (referred to as “you” or “your”) refers to the individual using our services
  • “Medical Partner” refers to JCI-accredited hospitals & surgeons we work with
  • “Package” refers to our all-inclusive service offerings: surgery, accommodation, and logistics
  • “Dr. Zahir” refers to Dr. Khalique Zahir, our US board-certified plastic surgeon

2. Acceptance of Terms

By accessing our website, booking a consultation, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are accessing our services on behalf of another person, you represent and warrant that you have the authority to bind that person to these Terms.

Age Requirement: You must be at least 18 years old to use our services. Patients under 18 require parental consent and must be accompanied by a parent or legal guardian throughout the entire process.


3. Our Services

Isthetique provides medical tourism coordination services, including:

  • Medical consultations with Dr. Zahir via telehealth
  • Coordination of cosmetic surgery procedures in Istanbul, Turkey
  • All-inclusive packages including surgery, accommodation, and transportation
  • Pre-operative and post-operative care coordination
  • HIPAA-compliant telehealth follow-up services
  • Multilingual support and patient advocacy
  • Travel and logistics assistance

Coordination Role: Isthetique serves as a medical tourism facilitator and coordinator. We do not directly provide medical services but coordinate care with our vetted medical partners in Turkey.


4. Medical Disclaimer

While Dr. Zahir provides oversight and our medical partners are carefully vetted, we cannot guarantee specific outcomes or results from any medical procedure. You acknowledge that:

  • All surgical procedures involve risks and potential complications
  • Results may vary and depend on individual factors
  • Revision surgeries may be necessary in some cases
  • Recovery times are estimates and may vary
  • You have been advised to seek independent medical opinions
  • Pre-existing medical conditions may affect outcomes

5. Booking and Payment Terms

Booking Process

  • Medical clearance may be required based on your health history
  • All bookings must be confirmed with a deposit
  • Final payment is due before travel or as specified in your package
  • Package inclusions are clearly outlined in your service agreement

Payment Terms

  • Deposits are typically 30-50% of the total package cost
  • Payment methods include bank transfers, credit cards, and approved payment platforms
  • Currency fluctuations may affect final pricing for international clients
  • Additional costs for complications or extended stays are patient responsibility
  • Travel insurance is strongly recommended and may be required

Medical Information: Health-related data is used exclusively for providing medical consultations, surgical planning, and post-operative care. This information is handled in compliance with international medical privacy standards.


6. Cancellation and Refund Policy

Cancellation policies vary depending on timing and circumstances:

Cancellation by Patient

  • More than 30 days before surgery: 80% refund of payments made
  • 15-30 days before surgery: 50% refund of payments made
  • Less than 15 days before surgery: 25% refund of payments made
  • No-show or same-day cancellation: No refund

Medical Cancellations

  • Cancellations due to medical unsuitability: 90% refund
  • Cancellations due to medical unsuitability: 90% refund
  • COVID-19 related restrictions: Rescheduling offered with no additional fees

Non-Refundable Items: Consultation fees, visa processing fees, and third-party booking fees are generally non-refundable. Travel and accommodation cancellations are subject to provider policies.


7. Patient Responsibilities

As a patient using our services, you agree to:

Pre-Surgery Responsibilities

  • Provide complete and accurate medical history
  • Follow all pre-operative instructions
  • Obtain necessary medical clearances if required
  • Arrange appropriate travel insurance
  • Ensure passport validity for at least 6 months
  • Disclose all medications and supplements

During Treatment

  • Follow all medical team instructions
  • Remain in Istanbul for the recommended recovery period
  • Attend all scheduled follow-up appointments
  • Report any concerns or complications immediately
  • Ensure passport validity for at least 6 months
  • Respect hospital and accommodation policies

Post-Surgery Responsibilities

  • Attend all telehealth follow-up sessions
  • Follow post-operative care instructions
  • Seek local medical care if complications arise
  • Maintain realistic expectations about results

8. Risks and Limitations

Medical Tourism Risks

  • Distance from home support systems
  • Language and cultural barriers
  • Different medical liability laws
  • Potential need for revision surgeries
  • Travel-related health risks
  • Extended recovery away from home

Service Limitations

  • We cannot guarantee specific surgical outcomes
  • Emergency medical care availability may vary
  • Follow-up care coordination has geographical limitations
  • Some complications may require local treatment upon return home
  • Insurance coverage for medical tourism may be limited

Assumption of Risk: You acknowledge and accept the inherent risks associated with medical tourism, including but not limited to surgical complications, travel risks, and differences in medical standards.


9. Intellectual Property

All content on our website and in our materials is protected by intellectual property laws:

  • Isthetique trademarks, logos, and branding materials
  • Website content, images, and design elements
  • Educational materials and procedure information
  • Dr. Zahir’s educational content and expertise
  • Before and after photographs (with patient consent)

You may not reproduce, distribute, or use our intellectual property without explicit written permission. Patient testimonials and photographs may be used for marketing purposes with your explicit consent.


10. Privacy and Confidentiality

Your privacy and medical confidentiality are paramount. We maintain strict standards for protecting your personal and medical information:

  • HIPAA-compliant data handling procedures
  • Secure encryption for all medical communications
  • Limited access to medical information on a need-to-know basis
  • Secure storage of all patient records
  • Compliance with international medical privacy standards

11. Limitation of Liability

To the maximum extent permitted by law, Isthetique’s liability is limited as follows:

  • Our liability is limited to the amount you paid for services
  • We are not liable for medical outcomes or complications
  • We are not responsible for third-party service provider actions
  • We are not liable for travel-related issues or delays
  • We are not responsible for accommodation or transportation problems

Excluded Damages

  • Indirect, incidental, or consequential damages
  • Lost wages or income during recovery
  • Pain and suffering not directly caused by our negligence
  • Punitive or exemplary damages
  • Damages arising from patient non-compliance

This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise.


12. Governing Law and Disputes

These Terms are governed by the laws of Turkey and the jurisdiction where services are provided. For dispute resolution:

Dispute Resolution Process

  • Step 1: Direct communication with our patient care team
  • Step 2: Formal complaint submission via email
  • Step 3: Mediation through approved healthcare dispute resolution services
  • Step 4: Arbitration in Istanbul, Turkey (if mediation fails)
  • Final Resort: Court proceedings in Istanbul jurisdiction

Medical Malpractice: Claims related to medical malpractice are subject to Turkish medical liability laws and must be addressed through appropriate medical boards and courts in Turkey.

You agree that any legal proceedings must be initiated within two (2) years of the completion of services or discovery of the issue, whichever comes first.

Life-Threatening Emergencies: Call 112 immediately for ambulance services. Contact our patient care line as soon as safely possible to coordinate with our medical partners.

Our patient care team will assist with emergency coordination, but immediate medical needs should always be addressed by calling local emergency services first.


14. Quality Assurance and Standards

Isthetique maintains high standards through:

  • Quarterly hospital audits and surgeon evaluations
  • Continuous surgeon training and certification requirements
  • Personal consultation and case review services
  • Quality control monitoring of patient outcomes

Partner Standards

  • JCI-accredited hospitals only
  • Board-certified surgeons with international training
  • Regular facility inspections and compliance checks
  • Patient safety protocols and infection control measures

While we maintain rigorous standards, you acknowledge that medical outcomes can vary and perfection cannot be guaranteed in medical procedures.
